Bombay High Court: Right to Sleep Inviolable

Bombay High Court on Monday said that the right to sleep is a basic human requirement and cannot be violated. The High Court said, The right to sleep and the right to blink is a basic human requirement. The High Court said this while hearing a plea by 64-year-old Ram Israni. Israni was alleged Israni has challenged his arrest by ED in a money laundering case.

Even as the High Court dismissed his plea, but the High Court disapproved of his questioning throughout the night. The court said that the agencies may record the statements of the accused during early hours and not at the night when a person’s cognitive skills may be impaired. H.S. Vina Gaunkar, who was the counsel for ED, argued that the practitioner had given his consent to his statement being recorded at night.

The High Court, however, said that consent is immaterial. The High Court also added that recording of statements at unearthly hours definitely results in deprivation of a person’s sleep and a basic human right of an individual. We disapprove of this practice.
